This Ordinance may be cited as the Money Lenders Ordinance.
This Ordinance shall have effect notwithstanding any agreement

PART II LICENSING OF MONEY LENDERS

No person shall carry on business as a money lender--
without a licence;
at any place other than the premises specified in such licence;

An application for a licence shall be made to the Registrar in

Where an application is lodged under section 9 (5), the

Without limiting the generality of the power of the licensing

Selection of assessors and payment of fees to assessors
Where under this Ordinance the licensing court is required

上海市劳动局、人事局关于颁发《上海市职业技能资格证书核发与管理的暂行规定》的通知

各区、县劳动局、人事局,各主管局(公司)劳动、人事部门:
遵照《劳动法》,根据国务院批准的《工人考核条例》、劳动部颁发的《职业技能鉴定规定》和劳动部、人事部《职业资格证书规定》、人事部《机关、事业单位工人技术等级岗位考核暂行办法》【人薪发(1994)50号】以及市劳动局、人事局联合颁发的沪劳技发(94)50号、沪人【1994】51号文件精神,制定了《上海市职业技能资格证书核发与管理的暂行规定》,现印发给你们,请遵照执行。
实行职业资格证书制度是国家在建立社会主义市场经济体制下,加强劳动人事科学化管理,保护社会公共利益,维护正常职业秩序的一项重要政策,为使本市顺利、健康地实施职业资格证书制度,现就本市职业技能资格证书的核发和管理提出如下贯彻意见:
一、市劳动人事行政部门是本市实施职业资格证书制度的主管部门,任何单位、部门未经同意不得任意组织有关职业技能资格的鉴定(考核)、评价及核发证书,也不得任意将本系统、本单位(部门)颁发的证书列入职业资格证书范围。
二、本市职业技能鉴定工作统一由市职业技能鉴定中心组织,按专业工种设立的职业技能鉴定站(所)具体实施。
市劳动行政部门综合管理本市各类各级职业技能资格证书。
三、考虑到本市实行按统一国家标准、统一鉴定规范、统一鉴定程序、统一鉴定机构、统一的考评员队伍、统一鉴定题库、统一资格证书、统一核证管理的“八统一”,为保证《工人考核条例》和《上海市社会化职业技能培训、考核(鉴定)、发证管理办法(试行)》【沪劳技发(94)46号】规定的办法与职业技能鉴定工作能逐步交替平稳过渡。因此,凡列入技能鉴定体系鉴定的工种,按《职业技能鉴定规定》执行,不再按沪劳技发(94)46号文进行考核、发证。暂没有列入技能鉴定体系鉴定的工种仍继续按沪劳技发(94)46号文执行。
四、自本规定发布之日起,本市实行统一职业技能资格证书的规定。凡已列入职业技能鉴定的工种,除国家劳动部、人事部和市劳动、人事行政部门核发的证书外,其它部门核发的技术等级证书将不再在全市范围内通用。

上海市职业技能资格证书核发与管理的暂行规定
第一章总则
第一条遵照《劳动法》,根据国务院《工人考核条例》、劳动部《职业技能鉴定规定》和劳动部、人事部颁发的《职业资格证书规定》及人事部《机关、事业单位工人技术等级岗位考核暂行办法》,结合本市实际情况,制定本暂行规定。
第二条凡属《国家职业技能标准》和《工人技术等级标准》或岗位规范所确定的专业工种,实行职业技能资格证书制度。
第三条施行职业技能资格证书制度是职业技能开发的一个中心环节,职业技能资格证书是反映劳动者技能水平的主要标志,是劳动力供求双方签订劳动合同的基本依据,是从业和执业的主要凭证。
第四条职业技能资格是对从事某一职业所必备的学识、技术和能力的基本要求。职业技能资格包括从业资格和执业资格。
从业资格是指从事某一职业(工种、岗位)学识、技术和能力的起点标准。
执业资格是指政府对某些责任较大,社会通用性强,关系公共利益的专业(工种)实行准入控制,是依法独立开业或从事某一特定专业(工种)学识、技术和能力的必备标准。
第五条职业技能资格证书是国家对申请人专业(工种)学识、技术能力的认可,是求职、任职、独立开业和单位录用的主要依据,同时也是出国劳务或技术研修时办理技术公证的有效证件。
第六条鉴定职业技能资格遵循申请自愿,费用自理,客观公正的原则。
凡居住本市的中华人民共和国公民和获准在本市就业的其他国籍的人员都可按照国家有关政策规定的程序申请相应的职业技能资格。
第七条职业技能资格证书实行政府指导下的管理体制,由市劳动人事行政部门管理。
第二章职业技能资格证书的种类
第八条本规定所称职业技能资格证书是指劳动部统一印制的《高级技师合格证书》、《技师合格证书》,《技术等级证书》和市劳动局统一印制的《技术等级证书》、《从业资格证书》、《执业资格证书》、人事部统一制定的《机关、事业单位工人技术岗位证书》。
第九条对一些从事技术要求复杂、通用性强、涉及产品质量和消费者直接利益以及国家财产和人民生命安全的工种岗位,实行就业与上岗的准入控制。实行从业资格和执业资格的工种由市劳动、人事行政部门会同行业主管部门或行业专业委员会确定。由市职业技能鉴定中心组织具体鉴定,并由市劳动、人事行政部门核发相应证书,其具体规定另定。
第三章职业技能资格证书的核发权限和效用范围
第十条《高级技师合格证书》、《技师合格证书》由市劳动行政部门核准颁发。机关、事业单位的职工须先获得市劳动行政部门颁发的《高级技师合格证书》、《技师合格证书》后,再经人事行政部门岗位技能考核合格后核发机关、事业单位的《高级技师岗位证书》和《技师岗位证书》。
第十一条劳动部印制的《技术等级证书》和人事部印制的《机关、事业单位工人技术岗位证书》核发办法:
(一)按《国家职业技能标准》、《技术等级标准》,经国家职业技能鉴定所鉴定合格者,由市劳动行政部门核发相应的由国家劳动部印制的《技术等级证书》。机关、事业单位的职工再由人事行政部门核发由人事部印制的《机关、事业单位工人技术岗位证书》。
(二)在新老证书管理交替过渡时期,凡需领取出国公证的职业技能资格证书者,须按劳动部、司法部《对出国工人技术等级、技术职务证书办理公证的规定》和国家及本市的有关政策规定,持原技术等级证书,由市职业技能鉴定中心组织复考,考核合格后换发市劳动行政部门验印的国家劳动部印制的《技术等级证书》。
第十二条市劳动行政部门印制的《技术等级证书》、《从业资格证书》核发办法:
本市凡暂未列入国家职业技能鉴定所鉴定的专业(工种),暂按以下规定核发上海市劳动局印制的《技术等级证书》、《从业资格证书》。
(一)按沪劳技发(94)46号文中关于社会化职业技能培训、考核、发证管理办法施行。
1、各工种高级工经市职业技能鉴定中心组织考核合格,由市劳动行政部门核发《技术等级证书》,在全市范围内有效。
2、经市劳动行政部门确定公布的特殊工种初、中、高级工,经市职业技能鉴定中心组织考核合格,由市劳动行政部门核发《技术等级证书》,在全市范围内有效。
3、除市劳动行政部门确定的特殊工种以外,其它工种的社会化的初、中级工培训、考核可仍由审批单位负责考核。需取得市劳动行政部门验印《技术等级证书》的,须纳入市职业技能鉴定中心统一组织考核。
4、实行《从业资格证书》的专业(工种)的岗位规范,由市劳动局组织制定并颁发。依据岗位规范,由市职业技能鉴定中心组织鉴定,合格者,颁发市劳动局验印的《从业资格证书》。
(二)经市劳动行政部门批复认可的有关主管局(公司)对本系统的职工按行业要求进行初、中、高级工的培训、考核,经考核合格者,由主管局(公司)核发技术等级证书。
第十三条职业技能资格证书是持证人职业技能水平的凭证,是用工单位对持证人聘用上岗任职和工资分配的依据。从事个体经营者,是向工商行政管理部门领取营业执照的有效凭证。
第四章职业技能资格证书的申领
第十四条申领技师、高级技师证书按市劳动、人事行政部门的有关规定执行。
第十五条按本市职业技能鉴定实施办法的规定,经国家职业技能鉴定所鉴定合格者,由市职业技能鉴定中心审核后,报市劳动行政部门核发劳动部印制的《技术等级证书》。申办证书者,必须经职业技能鉴定站(或考核站)考核合格。其申领办法是:
1、大专院校、技工学作、职业学校、培训中心等教育单位的毕业生申领证书,由学校统一向市职业技能鉴定中心提出申请,并附上《学员名册表》。学校按"鉴定中心"规定的时间组织学生到指定的职业技能鉴定站(或考核站)考核.考核合格者,由学校凭职业技能鉴定成绩通知书,到市职业技能鉴定中心办证。
2、社会化办学单位按照沪劳技发【1994】46号文中规定的精神办理。
3、在职职工培训班,需获市劳动行政部门验印的《技术等级证书》,办学部门须在学员开考前二周将学员花名册报送职业技能鉴定中心。经市职业技能鉴定中心认定的考核机构鉴定合格,由办班的单位(部门)凭鉴定成绩通知书,统一到市职业技能鉴定中心办证。
4、自学者申领职业技能资格证书,由申领者到职业技能鉴定所(或考核站)报名参加鉴定,鉴定合格者,由职业技能鉴定站持职业技能鉴定成绩单到市职业技能鉴定中心办理证书。
第五章职业技能资格证书的管理
第十六条职业技能资格证书填写应标准化、规范化。
(一)工种
必须按《中华人民共和国工种分类目录》或市劳动行政部制定的《技术等级标准》、《岗位规范》中规定的工种名称填写。
(二)考核种类
按《工人考核条例》中规定的要求,可分为录用考核,转正定级考核、上岗转岗考核、本等级考核、升级考核以及技师、高级技师任职资格考核。
(三)考核等级
1、本市已列入国家技能鉴定所鉴定及推行新标准的工种,按国家职业技能等级标准(技术等级标准)分初、中、高级工填写。
2、部分专业(工种),由于原属中级工技能要求较高、短时期内难以实现一次到位,故本市暂定在一九九七年十二月三十一日前,对部分中级工技能考核,可根据行业要求暂划分为二个至三个档。实行分阶段考核鉴定,暂发市劳动局印制的证书,待全部考核合格后换发劳动部印制的技术等级证书。
第十七条本市职业技能资格证书按国家标准规定,实行全市统一编号。
证书编号由年份、证书类别、行业编号和证书编号四个部分12位数组成。
其中行业编号使用《中华人民共和国工种分类目录》的编号。
第十八条本市实行《证书使用管理购买手册》制度,国家职业技能鉴定所、区(县)劳动局、人事局、主管局(公司)为"证书使用管理手册"持有使用单位,市职业技能鉴定中心负责办理具体手续。
第十九条各职业技能鉴定机构必须建立严格、完整的鉴定和证书核发档案,以备考查。
第二十条持证者必须妥善保管职业技能资格证书,遗失证书须登报声明作废,按程序重新办理补办手续。
第二十一条对骗取、转让、涂改职业资格证书的人员,一经发现,发证机关应取消其资格,收回证书,并报市劳动行政部门备案。
对伪造职业资格证书者,要依法追究责任。

各区、县劳动局、人事局,各主管局(公司)劳动、人事部门: 遵照《劳动法》,根据国务院批准的《工人考核条例》、劳动部颁发的《职业技能鉴定规定》和劳动部、人事部《职业资格证书规定》、人事部《机关、事业单位工人技术等级岗位考核暂行办法》【人薪发(1994)50号】以及市劳动局、人事局联合颁发的沪劳技发(94)50号、沪人【1994】51号文件精神,制定了《上海市职业技能资格证书核发与管理的暂行规定》,现印发给你们,请遵照执行。 实行职业资格证书制度是国家在建立社会主义市场经济体制下,加强劳动人事科学化管理,保护社会公共利益,维护正常职业秩序的一项重要政策,为使本市顺利、健康地实施职业资格证书制度,现就本市职业技能资格证书的核发和管理提出如下贯彻意见: 一、市劳动人事行政部门是本市实施职业资格证书制度的主管部门,任何单位、部门未经同意不得任意组织有关职业技能资格的鉴定(考核)、评价及核发证书,也不得任意将本系统、本单位(部门)颁发的证书列入职业资格证书范围。 二、本市职业技能鉴定工作统一由市职业技能鉴定中心组织,按专业工种设立的职业技能鉴定站(所)具体实施。 市劳动行政部门综合管理本市各类各级职业技能资格证书。 三、考虑到本市实行按统一国家标准、统一鉴定规范、统一鉴定程序、统一鉴定机构、统一的考评员队伍、统一鉴定题库、统一资格证书、统一核证管理的“八统一”,为保证《工人考核条例》和《上海市社会化职业技能培训、考核(鉴定)、发证管理办法(试行)》【沪劳技发(94)46号】规定的办法与职业技能鉴定工作能逐步交替平稳过渡。因此,凡列入技能鉴定体系鉴定的工种,按《职业技能鉴定规定》执行,不再按沪劳技发(94)46号文进行考核、发证。暂没有列入技能鉴定体系鉴定的工种仍继续按沪劳技发(94)46号文执行。 四、自本规定发布之日起,本市实行统一职业技能资格证书的规定。凡已列入职业技能鉴定的工种,除国家劳动部、人事部和市劳动、人事行政部门核发的证书外,其它部门核发的技术等级证书将不再在全市范围内通用。 一九九五年九月二十八日 附件: 上海市职业技能资格证书核发与管理的暂行规定 第一章总则 第一条遵照《劳动法》,根据国务院《工人考核条例》、劳动部《职业技能鉴定规定》和劳动部、人事部颁发的《职业资格证书规定》及人事部《机关、事业单位工人技术等级岗位考核暂行办法》,结合本市实际情况,制定本暂行规定。 第二条凡属《国家职业技能标准》和《工人技术等级标准》或岗位规范所确定的专业工种,实行职业技能资格证书制度。 第三条施行职业技能资格证书制度是职业技能开发的一个中心环节,职业技能资格证书是反映劳动者技能水平的主要标志,是劳动力供求双方签订劳动合同的基本依据,是从业和执业的主要凭证。 第四条职业技能资格是对从事某一职业所必备的学识、技术和能力的基本要求。职业技能资格包括从业资格和执业资格。 从业资格是指从事某一职业(工种、岗位)学识、技术和能力的起点标准。 执业资格是指政府对某些责任较大,社会通用性强,关系公共利益的专业(工种)实行准入控制,是依法独立开业或从事某一特定专业(工种)学识、技术和能力的必备标准。 第五条职业技能资格证书是国家对申请人专业(工种)学识、技术能力的认可,是求职、任职、独立开业和单位录用的主要依据,同时也是出国劳务或技术研修时办理技术公证的有效证件。 第六条鉴定职业技能资格遵循申请自愿,费用自理,客观公正的原则。 凡居住本市的中华人民共和国公民和获准在本市就业的其他国籍的人员都可按照国家有关政策规定的程序申请相应的职业技能资格。 第七条职业技能资格证书实行政府指导下的管理体制,由市劳动人事行政部门管理。 第二章职业技能资格证书的种类 第八条本规定所称职业技能资格证书是指劳动部统一印制的《高级技师合格证书》、《技师合格证书》,《技术等级证书》和市劳动局统一印制的《技术等级证书》、《从业资格证书》、《执业资格证书》、人事部统一制定的《机关、事业单位工人技术岗位证书》。 第九条对一些从事技术要求复杂、通用性强、涉及产品质量和消费者直接利益以及国家财产和人民生命安全的工种岗位,实行就业与上岗的准入控制。实行从业资格和执业资格的工种由市劳动、人事行政部门会同行业主管部门或行业专业委员会确定。由市职业技能鉴定中心组织具体鉴定,并由市劳动、人事行政部门核发相应证书,其具体规定另定。 第三章职业技能资格证书的核发权限和效用范围 第十条《高级技师合格证书》、《技师合格证书》由市劳动行政部门核准颁发。机关、事业单位的职工须先获得市劳动行政部门颁发的《高级技师合格证书》、《技师合格证书》后,再经人事行政部门岗位技能考核合格后核发机关、事业单位的《高级技师岗位证书》和《技师岗位证书》。 第十一条劳动部印制的《技术等级证书》和人事部印制的《机关、事业单位工人技术岗位证书》核发办法: (一)按《国家职业技能标准》、《技术等级标准》,经国家职业技能鉴定所鉴定合格者,由市劳动行政部门核发相应的由国家劳动部印制的《技术等级证书》。机关、事业单位的职工再由人事行政部门核发由人事部印制的《机关、事业单位工人技术岗位证书》。 (二)在新老证书管理交替过渡时期,凡需领取出国公证的职业技能资格证书者,须按劳动部、司法部《对出国工人技术等级、技术职务证书办理公证的规定》和国家及本市的有关政策规定,持原技术等级证书,由市职业技能鉴定中心组织复考,考核合格后换发市劳动行政部门验印的国家劳动部印制的《技术等级证书》。 第十二条市劳动行政部门印制的《技术等级证书》、《从业资格证书》核发办法: 本市凡暂未列入国家职业技能鉴定所鉴定的专业(工种),暂按以下规定核发上海市劳动局印制的《技术等级证书》、《从业资格证书》。 (一)按沪劳技发(94)46号文中关于社会化职业技能培训、考核、发证管理办法施行。 1、各工种高级工经市职业技能鉴定中心组织考核合格,由市劳动行政部门核发《技术等级证书》,在全市范围内有效。 2、经市劳动行政部门确定公布的特殊工种初、中、高级工,经市职业技能鉴定中心组织考核合格,由市劳动行政部门核发《技术等级证书》,在全市范围内有效。 3、除市劳动行政部门确定的特殊工种以外,其它工种的社会化的初、中级工培训、考核可仍由审批单位负责考核。需取得市劳动行政部门验印《技术等级证书》的,须纳入市职业技能鉴定中心统一组织考核。 4、实行《从业资格证书》的专业(工种)的岗位规范,由市劳动局组织制定并颁发。依据岗位规范,由市职业技能鉴定中心组织鉴定,合格者,颁发市劳动局验印的《从业资格证书》。 (二)经市劳动行政部门批复认可的有关主管局(公司)对本系统的职工按行业要求进行初、中、高级工的培训、考核,经考核合格者,由主管局(公司)核发技术等级证书。 第十三条职业技能资格证书是持证人职业技能水平的凭证,是用工单位对持证人聘用上岗任职和工资分配的依据。从事个体经营者,是向工商行政管理部门领取营业执照的有效凭证。 第四章职业技能资格证书的申领 第十四条申领技师、高级技师证书按市劳动、人事行政部门的有关规定执行。 第十五条按本市职业技能鉴定实施办法的规定,经国家职业技能鉴定所鉴定合格者,由市职业技能鉴定中心审核后,报市劳动行政部门核发劳动部印制的《技术等级证书》。申办证书者,必须经职业技能鉴定站(或考核站)考核合格。其申领办法是: 1、大专院校、技工学作、职业学校、培训中心等教育单位的毕业生申领证书,由学校统一向市职业技能鉴定中心提出申请,并附上《学员名册表》。学校按"鉴定中心"规定的时间组织学生到指定的职业技能鉴定站(或考核站)考核.考核合格者,由学校凭职业技能鉴定成绩通知书,到市职业技能鉴定中心办证。 2、社会化办学单位按照沪劳技发【1994】46号文中规定的精神办理。 3、在职职工培训班,需获市劳动行政部门验印的《技术等级证书》,办学部门须在学员开考前二周将学员花名册报送职业技能鉴定中心。经市职业技能鉴定中心认定的考核机构鉴定合格,由办班的单位(部门)凭鉴定成绩通知书,统一到市职业技能鉴定中心办证。 4、自学者申领职业技能资格证书,由申领者到职业技能鉴定所(或考核站)报名参加鉴定,鉴定合格者,由职业技能鉴定站持职业技能鉴定成绩单到市职业技能鉴定中心办理证书。 第五章职业技能资格证书的管理 第十六条职业技能资格证书填写应标准化、规范化。 (一)工种 必须按《中华人民共和国工种分类目录》或市劳动行政部制定的《技术等级标准》、《岗位规范》中规定的工种名称填写。 (二)考核种类 按《工人考核条例》中规定的要求,可分为录用考核,转正定级考核、上岗转岗考核、本等级考核、升级考核以及技师、高级技师任职资格考核。 (三)考核等级 1、本市已列入国家技能鉴定所鉴定及推行新标准的工种,按国家职业技能等级标准(技术等级标准)分初、中、高级工填写。 2、部分专业(工种),由于原属中级工技能要求较高、短时期内难以实现一次到位,故本市暂定在一九九七年十二月三十一日前,对部分中级工技能考核,可根据行业要求暂划分为二个至三个档。实行分阶段考核鉴定,暂发市劳动局印制的证书,待全部考核合格后换发劳动部印制的技术等级证书。 第十七条本市职业技能资格证书按国家标准规定,实行全市统一编号。 证书编号由年份、证书类别、行业编号和证书编号四个部分12位数组成。 其中行业编号使用《中华人民共和国工种分类目录》的编号。 第十八条本市实行《证书使用管理购买手册》制度,国家职业技能鉴定所、区(县)劳动局、人事局、主管局(公司)为"证书使用管理手册"持有使用单位,市职业技能鉴定中心负责办理具体手续。 第十九条各职业技能鉴定机构必须建立严格、完整的鉴定和证书核发档案,以备考查。 第二十条持证者必须妥善保管职业技能资格证书,遗失证书须登报声明作废,按程序重新办理补办手续。 第二十一条对骗取、转让、涂改职业资格证书的人员,一经发现,发证机关应取消其资格,收回证书,并报市劳动行政部门备案。 对伪造职业资格证书者,要依法追究责任。 第二十二条严格按市物价部门核准的收费标准收取职业技能鉴定费用和办证费用,严禁乱收费。 第六章附则 第二十三条本《暂行规定》自发文之日起施行。 第二十四条凡已发有关文件的规定与此文相抵触的,以此文为准。 第二十五条本《暂行规定》,由市劳动局,市人事局负责解释。 一九九五年九月二十八日
