内蒙古自治区统计法规检查监督办法
内蒙古自治区人民政府
第一条 根据《内蒙古自治区统计管理条例》(以下简称《条例》和有关法律法规,制定本办法。
第二条 本办法适用于统计法律法规实施情况的检查和对违反统计法律法规行为的查处。
第三条 旗县级以上统计机关负责统计法律法规的检查工作和查处统计违法行为。
各部门的统计机构,负责本系统统计法律法规的检查工作。
统计检查机构依法行使统计检查权,统计检查员执行检查任务,应出示《统计检查证》。
第四条 统计检查工作结合统计工作经常进行,旗县级以上统计机关认为必要时,可组织定期或不定期的全面大检查。
第五条 对符合《条例》第二十三条规定的单位和个人,旗县级以上统计机关可依法进行表彰或奖励,也可向有关单位提出表彰或奖励建议。
对违反统计法律法规的单位或个人,由旗县级以上统计机关依法处理,并抄报上级统计机关。
第六条 统计违法案件,按下列分工查处:
(一)旗县级以上单位、部门的统计违法案件,由所在地统计机关或会同盟市级以上统计机关查处;
(二)旗县级以下(不包括旗县级)单位、部门和公民的统计违法案件,由所在地旗县级统计机关查处;
(三)外商独资、中外合资经营、中外合作经营企业、事业单位的统计违法案件,由盟市级以上统计机关会同所在地统计机关查处;
(四)统计机关的统计违法案件,由上一级统计机关查处;
(五)在全区或全国范围内有重大影响和难以查处的统计违法案件,由自治区统计机关会同同级监察机关或报请国家统计局查处。
第七条 统计检查机构或统计检查员对检查中发现的以及举报、控告、移送、上级交办的统计违法行为,应认真审查,对需给予行政处罚或行政处分的应予立案,并填写《统计违法行为立案审批表》,报统计机关负责人审批。
调查处理统计违法案件不得少于二人。
第八条 统计违法案件经调查,事实清楚、证据确凿,符合《条例》第二十五条规定的,除责令纠正外,可分别给予下列行政处罚:
(一)警告;
(二)通报批评;
(三)罚款;
(四)停业整顿或吊销营业执照。
第九条 制发非法统计报表,进行非法调查,擅自公布统计资料的,对单位给予通报批评,可并处500元以下罚款;对责任人处以10至100元罚款。
第十条 拒报、屡次迟报(连续迟报统计资料三次以上或一年内迟报统计资料五次以上)的,对单位处以500至1000元罚款;对责任人处以50元至100元罚款。
第十一条 虚报、瞒报、伪造、篡改统计资料的,视其情节按下列规定给予处罚:
(一)虚假数据占单位报告期实际数据10%以下的,对单位给予警告,可并处500元以下罚款,对责任人处以50元以下罚款;
(二)虚假数据占单位报告期实际数据10%至20%的,对单位给予通报批评,可并处500元至1000元罚款,对责任人处以50元至100元罚款;
(三)虚假数据占单位报告期实际数据20%至30%的,对单位给予通报批评,可并处1000元至1500元罚款,对责任人处以100元至150元罚款,并可给予记过以下行政处分;
(四)虚假数据占单位报告期实际数据30%至40%的,对单位给予通报批评,可并处1500至2000元罚款;对责任人处以150元至200元罚款,并可给予记大过以下行政处分。
第十二条 不建立原始统计台帐,任意涂改、销毁原始记录,阻挠、抗拒检查,随意调离、撤换统计人员或因统计机构不健全严重影响统计工作以及违反《统计法》保密规定的,对单位给予通报批评,可并处1500至2000元罚款;对责任人处以150至200元罚款,并可给予
记大过以下行政处分。
第十三条 农民、牧民、个体工商户符合《条例》第二十五条第(一)、(二)、(三)、(五)、(六)、(十)项规定的,处以20到1000元罚款。
个体工商户违反《条例》情节严重的,可由统计机关建议工商行政管理机关给予停业整顿或吊销营业执照的处罚。
第十四条 违反统计法律法规,有下列情形之一的,从轻或免于处罚:
(一)自己主动查出并及时纠正的;
(二)违反统计法律法规情节轻微的;
(三)违反统计法律法规经有关部门查出后,认真检查错误并及时纠正的;
经办人员抵制无效被迫执行的,对经办人可从轻或免于处罚。
第十五条 违反统计法律法规情节严重有下列情形之一的,对单位处以5000元以下罚款;对责任人处以500元以下罚款,并可给予撤职以下行政处分:
(一)虚报、瞒报、伪造、篡改统计资料情节严重,虚假数据占单位报告期实际数据40%以上的;
(二)阻挠、抗拒检查或拒不纠正错误的;
(三)屡查屡犯,拒不悔改的。
利用职权授意或胁迫统计人员弄虚作假造成危害,侵犯统计机构、统计人员的法定职权,对依法行使职权的统计人员打击报复造成后果的,以及统计检查人员行使职权弄虚作假、不依法办事的,对责任人处以500元以下罚款,并可给予撤职以下行政处分。
第十六条 同期查出两种以上违法行为的,应按照最重行为处罚,但是罚款合并计算。
第十七条 违反统计法律法规构成犯罪,司法机关依法免于起诉或免于追究刑事责任的,由原查处统计机关按照本办法处理。
第十八条 对单位的警告、通报批评、罚款以及对责任人的罚款由统计机关作出决定。
第十九条 统计违法案件经调查,事实清楚、证据确凿,对责任人给予行政处分的,由统计机关填写《统计违法案件处理意见书》,按照人事管理权限送有关单位、部门。有关单位、部门在收到意见书之日起三个月内作出处理,并将处理结果回执退回。三个月未作处理的,统计机关可
直接报请人事、监察机关处理。
第二十条 单位交纳的罚款,企业在留用利润中支付,行政事业单位在预算外资金或包干节余经费中支付;个人缴纳的罚款,由本人或其所在单位从个人工资中扣缴。
第二十一条 本办法所称的“以上”、“以下”,除注明外,均包括本数。
第二十二条 本办法自公布之日起施行。

农业部关于加强农业机械化技术推广工作的意见

各省、自治区、直辖市及计划单列市农机(农业、农牧)局(厅、委、办),新疆生产建设兵团农业局,黑龙江省农垦总局:
为认真贯彻实施新修订的《中华人民共和国农业技术推广法》(以下简称《推广法》),深入贯彻落实中央一号文件有关政策措施,进一步加强农业机械化技术推广工作,促进农业机械化技术普及应用,强化对建设现代农业的支撑,现提出如下意见。
一、深刻认识加强农业机械化技术推广工作的重要意义
近些年来,我国农机化技术推广工作稳步推进,农业机械化技术集成创新,先进适用技术加快应用,技术领域进一步拓展,推广机制不断创新,为促进农业机械化又好又快发展、保障国家粮食安全、促进农民增收,建设现代农业做出了积极贡献。
当前,我国农业发展进入了传统农业向现代农业转变的关键时期,农业机械化正处在加快发展、改善结构、提升质量、拓宽领域的重要阶段。农业机械化技术推广工作面临着新形势、新任务和新要求。农业机械是农业科技的物化载体,农业机械化技术推广是农业技术推广的重要组成部分,是加快农业发展方式转变的重要力量。加强农业机械化技术推广工作有利于实现农机农艺融合、农机化与信息化融合、加快构建高产、优质、高效、生态、安全农业技术体系;有利于加快推广农机化先进适用技术,不断提高土地产出率、资源利用率、劳动生产率;有利于增强农业综合生产能力、抗风险能力和市场竞争力,促进农业稳定发展和农民持续增收。加强农业机械化技术推广工作不仅关系农业机械化发展的速度和质量,而且关系农业现代化的进程。
各级农业机械化主管部门和农业机械化技术推广机构要认真实施《推广法》,深入贯彻落实中央一号文件精神,充分认识加强农业机械化技术推广工作的重要意义,进一步增强紧迫感、责任感和使命感,充分发挥农业机械化在推动农业技术集成、节本增效、推动规模经营等方面的重要作用,为农业现代化提供有力支撑。
二、进一步明确农业机械化技术推广工作的指导思想、基本原则和总体目标
(一)指导思想
更加自觉地深入贯彻落实科学发展观,紧紧围绕粮食等主要农产品有效供给、农民持续增收和农业可持续发展的战略需求,以加快农机化发展方式转变为主线,以促进农机与农艺融合、农机化与信息化融合为着力点,切实贯彻落实有关法律法规和政策,强化国家农业机械化技术推广机构公益性职能,加强推广体系建设、人才队伍建设、设施条件建设和推广工作规范化建设,提升推广服务能力和效率,加快增产增效型、资源节约型、环境友好型为重点的农机化技术普及应用,为推进农业机械化又好又快发展和建设现代农业提供强有力的科技支撑。
(二)基本原则
——坚持政府主导,社会参与。实行公益性推广与经营性推广分类管理,明确国家农业机械化技术推广机构的公益性定位,充分发挥市场机制作用,广泛吸引科研、教学、企业、社会经济组织和个人等多种社会力量投身农业机械化技术推广事业。
——坚持试验示范,农民自愿。试验先行,加大试验力度,确保技术先进、适用和安全,维护农民利益。尊重农民意愿,维护农民选择和应用技术的自主权。通过典型示范,政策引导,广泛开展宣传和培训,调动农民应用技术的积极性。
——坚持机制创新,提高效率。创新完善机制,推动农机与农艺技术融合,农机化与信息化融合,技术推广与经营方式协调发展。鼓励运用现代信息技术等先进手段创新农业机械化技术推广方式方法,提高推广效率。
——坚持因地制宜,注重效益。根据不同区域的自然禀赋、耕作制度和经济条件,采取适宜的技术路线。兼顾社会效益、经济效益,注重生态效益,促进农业可持续发展和农民持续增收。
——坚持突出重点,全面推进。选好重点区域,抓住薄弱环节,把握主推技术,集中优势资源,扶强带弱。尊重农业机械化技术推广规律,以点带面,促进全面发展。
(三)总体目标
“十二五”农机化技术推广工作的总体目标是:农机化技术推广体系进一步完善,推广服务能力明显增强,人才队伍建设取得新成效,增产增效型、资源节约型、环境友好型农业机械化技术得到大面积推广,粮棉油糖等大宗农作物机械化薄弱环节实现明显突破,先进适用、技术成熟、安全可靠、节能环保、服务到位的农机装备广泛应用,装备结构明显改善,为农业机械化又好又快发展提供有力的技术和装备保障。
三、积极推进农业机械化技术推广体系建设
(一)强化机构建设。强化主体,依法确立推广机构的公共服务性质,明确公益性职责,因地制宜地建立健全县、乡镇或区域国家推广机构,确定机构人员编制,按规定的比例设置专业技术人员岗位。实行乡镇推广机构以县级推广部门管理为主或以乡级政府管理为主、县级推广部门业务指导的管理体制,加快建立起机构健全、职责明确、运行高效、服务到位的农业机械化技术推广机构。
(二)强化队伍建设。加强与有关部门沟通协调,落实推广机构人员编制数量和结构比例,健全完善队伍。全面推进人员聘用管理,明确上岗条件和人员进出考评机制,实施基层农技推广特岗计划,鼓励和引导农科大学生从事基层推广工作,不断优化队伍结构。广泛开展学历提升教育、分层分类定期培训、实施好万名农技推广骨干培养工程,不断更新知识、提升素质。
(三)强化条件建设。制定基层农业机械化技术推广机构建设规划,落实中央一号文件关于农业技术推广机构条件建设项目覆盖全部乡镇等政策措施,加强基层推广机构办公条件、设施设备、试验示范基地等建设,着力提升基层农机推广机构条件能力,确保农业机械化技术推广人员工作有场所、服务有手段、下乡有工具,为广大农民提供及时、便捷、高效的服务。
(四)强化多元服务。适应现代农业发展进程中农民多领域、多样化、全方位的服务需求,完善制度措施,引导科研教学单位成为公益性技术推广的重要力量,深入基层开展技术指导咨询服务,解决农业生产一线的实际问题。发挥农机专业合作社、农机企业、群众性农机科技组织及其它社会力量的推广作用,多渠道为农民提供各种形式的农业产前、前中、产后全程服务,提高农民应用技术的组织化程度。
四、大力推广农业机械化先进适用技术和装备
(一)加强示范区建设。科学规划,合理布局,建立试验示范基地。集中人力、物力、财力,把示范区建成方便试验、具备示范、利于宣传的基地。建立完善农业机械化技术先进性、适用性和安全性等试验评价的方法,为开展试验示范提供支持。
(二)强化试验示范。立足农业生产实际需要,选择引进技术,认真组织试验,探索适合当地机械化生产的工艺流程、技术模式,确定主推作物品种、农机化技术和成熟机型。广泛布点示范,展示示范效果,以点带面,引导农民自觉应用。
(三)注重培训指导。通过培训,使基层农业机械化技术推广人员掌握技术要点、学会技术推广方法,指导农民掌握技术要领、正确操作使用机具。发挥专家、技术推广骨干作用,及时提供技术咨询服务,解决农民疑难问题,加快农业机械化技术普及应用。
(四)实行全面推进。以主要粮食作物关键环节为重点,加强技术集成示范,加快实现瓶颈技术突破。围绕优势农产品区域布局,因地制宜推广重点环节机械化技术,加快提升经济作物、畜牧水产养殖业、林果业、草业、种业、农产品初加工业、设施农业和农业废弃物综合利用机械化水平。
五、不断创新完善农业机械化技术推广机制
(一)创新完善协作机制。突出“一主多元”整体作用发挥,运用行政工作协调、重大项目集聚、市场机制引导等有效手段,努力打破部门、地域、单位界限,统筹配置农机化技术推广服务资源,推进国家农机推广机构、农机科研教学单位、农机专业合作社、农机企业在农业机械化技术推广中联合协作,形成产学研推紧密结合、公益性推广与经营性推广优势互补、专项服务与综合性服务良性互动的农机化技术推广工作新机制。
(二)创新完善运行机制。建立完善工作责任制度,将法定的推广服务职能细化落实到每个岗位人员,明确服务对象、服务内容、服务时间和服务要求。建立完善工作考评制度,以机构职能、岗位职责、工作目标、工作实绩等为依据,量化考核指标,制定考核办法,加强对机构和人员的考评。建立完善激励制度,将推广人员的考评结果作为绩效工资兑现、职务职称晋升和聘任、续签聘任合同、调整岗位、技术指导员补助、学历提升、知识更新培训和评先评优的主要依据。
(三)创新推广服务方式。充分利用现代信息技术、人工智能技术,通过广播、电视、网络、农机110、手机短信等现代服务手段,不断探索建立高效、便捷、实用的农业机械化技术推广服务信息平台,推进技术服务信息化、农机化与信息化融合,提高推广服务效率,促进先进农业机械化科研成果和实用技术快速转化应用,尽快形成生产力。
六、切实加强农业机械化技术推广工作的组织领导
(一)摆上重要位置,落实工作责任。各级农业机械化主管部门要切实加强农业机械化技术推广工作的领导,把推广工作纳入农业机械化工作绩效考核指标体系,并将条件能力建设纳入当地农业机械化发展和经济社会发展的总体规划,科学谋划,强化措施,抓出成效。各地农业机械化主管部门要结合本地实际,认真研究提出加强农业机械化技术推广工作的指导意见,充分发挥农业机械化技术推广机构的技术支撑作用。农业机械化鉴定、监理、培训等机构要根据各自职责,与农业机械化技术推广机构密切配合,共同促进农业机械化技术推广工作。各级农业机械化推广机构要围绕全面履行职责,切实加强自身建设,落实工作责任。
(二)落实政策法规,完善保障措施。要认真贯彻《农业机械化促进法》、《农业技术推广法》、《国务院关于促进农业机械化和农机工业又好又快发展的意见》,制定相配套的地方性法规或实施办法,促进各项农业机械化科技创新、技术推广及体系建设扶持政策措施的落实。要积极协调落实中央一号文件提出的“一个衔接、两个覆盖”政策,改善基层人员待遇水平和工作条件。要依法保障推广人员的合法权益,调动推广人员的积极性。充分发挥农机购置补贴的调控作用,把实施农机购置补贴政策与农业机械化技术推广工作紧密结合,优先保证重点和薄弱环节作业机械购置补贴。积极推动扩大农机作业补贴范围,加大技术推广应用补助力度,调动农民应用先进农业机械化技术的积极性。
(三)加大资金投入,强化项目带动。要积极协商、落实农业机械化技术推广机构人员经费和工作经费,加强基层推广机构条件建设,确保推广工作正常运转。要科学谋划项目,发挥项目带动作用,促进农业机械化科技创新、示范推广条件改善和技术应用。要加强农业装备自主创新重大项目的科学论证和立项工作,着力研制适合农业生产需要的农业装备,突破农业机械化技术瓶颈。实施好农业技术试验示范专项(农机)经费项目、保护性耕作工程建设规划项目、阳光工程农机培训项目,不断加大农业机械化技术推广投入。依托实施农业机械化推进工程,加强农业机械化技术推广服务设施建设,提高农业机械化技术推广公共服务能力。
(四)加强信息宣传,营造良好环境。要加强农业机械化和农业机械化技术推广工作宣传,宣传发展农业机械化对建设现代农业,转变农业发展方式的重大意义,宣传农业机械化技术推广工作的重要作用,取得各级政府、有关部门及社会各界的关心和支持,营造农业机械化发展良好的社会氛围。要充分利用广播、电视、报刊、网络等媒体,以群众喜闻乐见的形式,大力宣传农业机械化新技术新装备。要积极宣传模范农机推广人物的事迹,弘扬为民、务实、清廉的优良作风,展示农机人的风采。要加强调查研究,善于发现新典型,总结新经验,推广好做法,充分发挥典型引路的作用,不断提高农业机械化技术推广工作水平。

There is hereby established a board to be known as the Protection
of

The Board shall consist of a Chairman appointed under the Schedule

more than 10 members appointed by the Governor as follows--
subject to paragraph (b) not more than 4 public officers;

any other sums required or permitted to be paid by the Fund under

PART IV FINANCIAL PROVISIONS

The Board may, from time to time, with the prior approval
of the

In each financial year, before a date to be fixed by the Governor,

Review by Board
Any applicant aggrieved by any decision of the Commissioner
under
ion 16 may in writing--
request the Commissioner to give reasons for that decision; and
after being given reasons under paragraph (a),
request the
issioner to refer the application to the Board.
Upon receiving a request from an applicant under subsection (1)
(b),
Commissioner shall forward all documents relating to the
application

The Board may confirm or vary any decision of the Commissioner
on an
ication referred to it under this section or may for those
purposes
ire the Commissioner to make further inquiries relating
to the

Additional power of Commissioner
Notwithstanding that in any particular case a petition referred
to in
ion 16 (1) (a) (i) or (b) has not been presented against an
employer,
Commissioner may, subject to subsection (2) of that section,
make an
ratia payment under that section in that case if in his opinion--

the employer employs less than 20 employees;
sufficient evidence exists to support the presentation of a
petition

if the employer is a company, that he is unable to pay his debts;

if the employer is a person other than a company, that

case.
Where the Commissioner exercises his discretion under
subsection (1)
ake payment, he shall give notice in the Gazette stating that,
in his
ion, sufficient evidence exists to support the
presentation of a

if the employer is a company, that he is unable to pay his debts;

if the employer is a person other than a company, that
he has

Nothing in subsection (2) shall require the Commissioner to give

one notice in respect of each employer.
No action shall lie against the Commissioner in respect of any

n under subsection (2).
Verification of application
For the purpose of verifying any application under section 15,
or if
equired by the Board under section 17 (3), the Commissioner may
